====================================================== CORAM: HONOURABLE MR. JUSTICE ALOK KUMAR SINHA ORAL ORDER 23-12-2025 Heard learned counsel for the petitioner, learned counsel for Bihar Sanskrit Shiksha Board and learned counsel for respondents-State.

2. With the consent of the parties, the present writ application is being disposed of at this stage itself.

3. In the present writ application the petitioner has

2/6 prayed for the grant of following reliefs:

"(i) For issuance of an appropriate directing the respondents to make necessary correction/modification for the implementation of 6th pay scale to the petitioner with effect from1.04.2006 and monetary benefit with all benefits from 01.04.2007 as like Government High School and Government Minority High Schools in place of 01.04.2013 for which the petitioner is entitled under the law.

(ii) For issuance of an appropriate directing the respondents to make necessary correction/modification for the implementation of Vth pay scale to the petitioner with effect from 1.01.1986 and all monetary benefits from 01.03.1989 as like the Government High School or Minority Government High School in place of 01.04.1998.

(iii) For issuance of an appropriate writ in the nature of mandamus for commanding and directing the

3/6 Respondents to give benefits of the 7th revision of pay scale to the petitioner with same date and same effect from 01.04.2017 as like Government School and Government aided minority school which the petitioner is entitled under the law.

(iv) For issuance of an appropriate directing the respondents to make payment of 5th pay scale with all benefits, service allowance and other service benefits to the petitioner in the aforesaid school as like the Government High School. And minority Madarsa High School in the State of Bihar. And further respondents be directed to give payment of 6th pay scales with all benefits to the petitioner as like Government High School and minority Madarsa High Schools.

(v) For issuance of an appropriate mandamus for commanding and directing the respondents to give priority in payment of salary i.e.

salary allowance and other service benefits of the aforesaid school to the

4/6 petitioner Assistant Teacher Government High School and Minority Madarsa School in the State of Bihar.

(vi) For issuance of an appropriate directing the respondents to give the benefits of the respondents State Government decision memo no.237 dated 20.02.1990 of the aforesaid school to the petitioner as like Government School. And minority Madarsa High School for which the petitioner is fully entitled under the law.

(vii) For issuance of any other reliefs which petitioners may be found in the eyes of law."

After advancing some argument, learned counsel for the petitioner submits that for redressal of his grievances as raised in the present writ application, the petitioner is prepared to file a detailed representation before the District Education Officer, Gaya (respondent no.6) and he further submits that if such a representation is filed by the petitioner, appropriate direction be issued to the District Education Officer, Gaya to dispose of the said representation filed by the petitioner within a

5/6 fixed time frame, after giving an opportunity of hearing to the petitioner.

5. To the aforesaid prayer being made by learned counsel for the petitioner, learned counsel appearing for Bihar Sanskrit Shiksha Board and learned counsel for respondentsState do not have any objection.

Considering the limited nature of prayer being made by learned counsel for the petitioner, this writ application is disposed of granting liberty to the petitioner to file a detailed representation before the District Education Officer, Gaya within one month from the date of passing of this order, and if such a representation is filed, the District Education Officer, Gaya shall dispose of the same within a further period of six months from the date of filing of the representation, after giving an opportunity of hearing to the petitioner. Needless to emphasize that the final order which shall be passed by the District Education Officer, Gaya should be a reasoned and speaking order. It is further made clear that in case the petitioner is found entitled to the relief, which the petitioner would be claiming through its representation, the same should be extended to the petitioner within further period of three months from the date of passing of the final order.

7. With the aforesaid observation and direction and liberty as granted, the present writ application stands disposed of. Pending I.As, if any will be deemed to have been disposed of.
