The petitioners seek regular bail in connection with Manjhi P.S. Case No. 256 of 2019 for the offences punishable under Sections 30, 30(g) and 38(1) (ii) of the Bihar Prohibition and Excise Act, 2016.

The allegation is regarding recovery of 3879.36 liters of illicit liquor from a TATA 407 truck, after the same was intercepted by the police and a search was made. The learned counsel for the petitioners submits that the petitioners are driver and Khalasi of the said truck and they are not the main culprits inasmuch as the illicit liquor recovered

Patna High Court CR. MISC. No.80045 of 2019(2) dt.05-12-2019 2/2 by the police does not belong to them. It is further submitted that the petitioners are having a clean antecedent and are languishing in custody since 02.09.2019.

Having regard to the facts and circumstances of the case, the petitioners, above named, are directed to be enlarged on regular bail on furnishing bail bonds of Rs. 10,000/- with two sureties of the like amount each to the satisfaction of learned 2nd Additional Sessions Judge cum Special Judge Excise, Saran at Chapra in connection with Manjhi P.S.
