JUSTICE VINOD KUMAR SINHA ORAL ORDER 18-01-2019 The petitioner apprehends his arrest in connection with Excise Case No. 11 of 2015 registered under Sections 47(a)(f) of the Bihar Prohibition and Excise Act.

Allegation as per FIR is of recovery of 50 litres of Mahua liquor and 905 Kg Mahua flower.

Submission of learned counsel for the petitioner is that the FIR itself discloses that recovery is made from near the bank of river and petitioner has no criminal antecedent. Heard learned APP also.

Having heard both sides and in the facts and circumstances, as stated above, let the petitioner, abovenamed, in the event of arrest or surrender before the court below within a period of six weeks from the date of receipt of a copy of this

No.1217 of 2019(2) dt.18-01-2019 2/2 order, be released on bail upon furnishing bail bond of Rs. 25,000/- (Rupees twenty five thousand) with two sureties of the like amount each to the satisfaction of the learned Additional Sessions Judge-II-cum-Special Judge, Excise, Sasaram, Rohtas in connection with Excise Case No. 11 of 2015; subject to condition as laid down under Section 438(2) of the Code of Criminal Procedure.
