The petitioner apprehends his arrest in Warisnagar (Mathurapur O.P.) P.S. case No. 65 of 2017 registered under Section 420, 409, 467, 468, 471, 120B of the Indian Penal Code. The informant filed complaint case No. 1519 of 2017 before the C.J.M., Samastipur who sent the same for registration and investigation under Section 156(3) of the Cr. P. C. The informant named six persons and alleged that they persuaded the informant and others to deposit in the company but the company did not return the money and fled away. The learned counsel for the petitioner submits that petitioner is not named in the FIR. The name of petitioner figured in the case during the course of investigation in the supervision note. It is alleged that petitioner is a witness in the

Patna High Court Cr.Misc. No.80072 of 2018(2) dt.15-01-2019 2/2 rent agreement executed between officers of the company and landlord.

It appears that petitioner did not persuade any investor to deposit money in Indus Weir Industries Ltd. The petitioner is a Govt. employee.

Considering the facts aforesaid and the nature of allegation made against the petitioner, the petitioner, above named, in the event of his arrest or surrender before the learned court below within a period of four weeks from the date of receipt/ production of a copy of this order is directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Samastipur in connection with Warisnagar (Mathurapur O.P.) P.S. case No. 65 of 2017, subject to conditions as laid down under Section 438(2) of the Code of Criminal Procedure.
