28-02-2020 Heard learned counsel for the petitioner, learned A.P.P. as well as learned counsel for the informant. The petitioner apprehends his arrest in Jaynagar P.S. Case No. 05 of 2019 registered for the offence under Sections 304(B), 201, 120(B) of the Indian Penal Code. As per prosecution case, the daughter of the informant was got married with petitioner in the year 2012 and out of the wedlock, three children were born. It is alleged that accused persons were torturing the deceased due to non-fulfillment of demand of dowry, as a result of which, a complaint was filed in the year 2017. But thereafter, on compromise, the daughter of the informant was brought to her matrimonial house. On 16-10-2018, the petitioner informed the informant on mobile that her daughter had died. Immediately thereafter, the informant came to village of her daughter and came to know
Patna High Court CR. MISC. No.82006 of 2019(3) dt.28-02-2020 2/2 from the villagers that her daughter was done to death on 10-10-2019 by all her in-laws members (mentioned in complaint petition) and thereafter, she was cremated on the same night. Considering the fact that petitioner is husband of the deceased and there is specific allegation against him, I am not inclined to grant anticipatory bail.
