JUSTICE CHAKRADHARI SHARAN SINGH ORAL ORDER 13-12-2019 It is the petitioner's case that a tube-well has been installed under the supervision of Executive Engineer, Tubewell Department, West Champaran, Bettiah over the petitioner's land. Because of faulty installation of tube-well the crops in the petitioner's land have got damaged and the quality of soil has deteriorated.

This writ application has been filed seeking direction to pay compensation for the loss caused to the petitioner. This Court in a proceeding under Article 226 of the Constitution of India cannot determine and quantify the loss caused to the petitioner in absence of any judicially

This application, in my view, cannot be maintained and is accordingly dismissed. It goes without saying that the petitioner may avail the remedy of approaching competent court of civil jurisdiction or any other forum for redressal of his grievance.
