JUSTICE RAJEEV RANJAN PRASAD ORAL ORDER 03-12-2019 Heard learned counsel for the petitioner and learned Additional Public Prosecutor for the State. The petitioner in the present case is seeking regular bail in connection with Dumariya P.S. Case No. 07 of 2019 registered under Sections 147, 148, 149, 341, 323, 504, 452, 436 of the Indian Penal Code and Section 3⁄4 of the Explosive Substance Act and Section 16, 18, 20 and 23 of the U.A.P. Act.

Learned counsel for the petitioner submits that petitioner has falsely been implicated in this case due to village politics, petitioner is not named in the F.I.R. and petitioner is in custody since 25.09.2019.

Learned A.P.P. for the State has opposed the

Considering the facts and circumstances of the case wherein it is submitted that the name of the petitioner has transpired in the confessional statement of co-accused Tuntun Singh Bhokta, the F.I.R. is against 50-60 unknown Naxalities, this petitioner has no criminal antecedent and the co-accused has already been granted regular bail on 26.07.2019 by a learned Coordinate Bench of this Court in Cr. Misc. No. 46374/2019, let the above-named petitioner be released on bail furnishing bail bond of Rs. 15,000/- (Rupees Fifteen Thousand only) with two sureties of the like amount each to the satisfaction of learned Judicial Magistrate - 1st Class, Sherghati, Gaya, in connection with Dumariya P.S. Case No. 07 of 2019, subject to the condition as laid down under Section 437(3) Cr.P.C.
