JUSTICE MOHIT KUMAR SHAH ORAL ORDER 15-02-2024 The present writ petition has been filed seeking the following reliefs:- "1(i). In the nature of "mandamus" directing and commanding the respondents authorities to pay the petitioner the dues of her husband while he was in service which are as follows- (a). Payment of due salary with effect from July 2005 to 14th November, 2006.

(b). Payment of salary with effect from 18.09.2011 to 14.11.2015.

(c). Left over payment of subsistence allowance with effect from December, 2006 to 14.11.2011. (ii). In the nature of "mandamus" directing and commanding the respondents authorities to grant

Patna High Court CWJC No.444 of 2024(2) dt.15-02-2024 2/2 the husband of the petitioner the benefit of ACP and MACP which has not been provided and calculate the entire retiral dues accordingly including the family pension for which she is entitled and make payment of entire arrears forthwith along with statutory as well as penal interest."

At the outset, the learned counsel for the petitioner seeks liberty on behalf of the petitioner to approach the District Magistrate, Gaya, i.e. the Respondent No. 2, for redressal of her aforesaid grievances. Liberty, so sought, is granted. 3.

It is needless to state that in case the petitioner approaches the Respondent No. 2, by filing appropriate representation, within a period of two weeks from today, the same shall be disposed off, by a reasoned and a speaking order, in accordance with law, within a period of six weeks, thereafter. 4.

The writ petition stands disposed off on the aforesaid terms.
