2. The petitioner has prayed for regular bail in a case registered for the offence punishable under sections 25 (1-b)a, 26, 27 and 35 of the Arms Act.

3. The case of the prosecution is that the petitioner along with another co-accused attempted to steal the solar panels installed in the community building. When the informant raised an alarm, the co-accused, Badal Kumar allegedly fired two shots at the informant, however, the informant managed to escape.

4. Learned counsel for the petitioner submits that the petitioner is innocent and has falsely been implicated in connection with the present case. It is further submitted that

Patna High Court CR. MISC. No.85151 of 2025(2) dt.16-12-2025 2/2 from perusal of the FIR, it is apparent that there is a specific and direct allegation against the co-accused, Badal Kumar of firing. There is no allegation against this petitioner of having fired any shot . The only allegation against the petitioner is that he was present at the spot. It is further submitted that nothing has been recovered from the conscious possession of this petitioner. Moreover, the petitioner is languishing in judicial custody since 14.05.2025.

5. Learned APP appearing for the state has opposed the prayer of regular bail stating that the petitioner has four criminal antecedents.

6. Considering the aforesaid facts and circumstances of the case, this court is inclined to enlarge the petitioner on bail. The above named petitioner is directed to be released on bail in connection with Beldaur P.S. Case No. 32 of 2025 on furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Judicial Magistrate, 1st Class, Khagaria.
