1. Heard learned counsel for the parties concerned.

2. Mrs. Shama Sinha, learned counsel for the petitioner, submits that the petitioner is resident of Raj Apartment, Ashiyana Nursing Home, Ashiana Nagar, P.S. Shatri Nagar, Patna. The petitioner has filed the present writ application for direction to the respondent-authorities,

Patna High Court CWJC No.705 of 2025(2) dt.19-09-2025 2/3 particularly, Registration Department to act on the complaint/representation of the petitioner and to conduct enquiry into the registration of Raj Apartment Niwasi Kalyan Swawlambi Sahkari Samiti Ltd.

3. According to the petitioner, the Apartment, in question, is having its Resident Welfare Association in existence. However, certain new occupants/owners of the Apartment formed a Society in violation of the provisions of the Bihar Apartment Ownership Act , 2006, besides committing other irregularities and got it registered, for which, a complaint has been filed by the petitioner before the Registration Department.

It has further been submitted that newly formed society has also submitted an application before the Electricity Department to transfer the meter in their name which the Electricity Department has refused in view of the fact that Registrar, Co-operative Society, has now started enquiry upon the complaint of the petitioner.

5. Accordingly, learned counsel for the petitioner submits that the present writ application may be disposed with direction to the Registrar, Co-operative Society, to complete enquiry within a reasonable time frame.

Taking into consideration the aforesaid submission of the parties, the present writ application is disposed with direction to the Office of Registrar Co-operative Society, to complete the enquiry in accordance with law after giving opportunity of hearing to the concerned persons within a period of five months.

7. With the aforesaid observations and directions, this writ application stands disposed.
