2. The petitioner has prayed for regular bail in a case registered for the offence punishable under sections 395 and 397 of the Indian Penal Code.

3. The case of the prosecution is that seven unknown miscreants have entered in the house of the informant. They had made firing and took away the valuables from his house.

4. Learned counsel for the petitioner submits that the petitioner is innocent and has committed no offence. Learned counsel for the petitioner has submitted that the FIR was lodged against unknown miscreants. During course of investigation, one Samsuddin Nadaf has given his confessional statement and in his confessional statement, he has named the son of the

It has further been submitted that petitioner has been framed in this case as there was hot talk between police and the petitioner when the police went there to apprehend his son. It has also been submitted that Samsuddin on whose confession, the name of the petitioner's son and others have surfaced has already been granted bail by learned co-ordinate Bench of this Court vide order dated 20.08.2025 passed in Cr. Misc. No. 40583 of 2025. The case of this petitioner stands on better footing. Moreover, he is languishing in judicial custody since 26.05.2025.

5. Learned APP appearing for the State has vehemently opposed the prayer of regular bail.

6. Having heard learned counsel for the parties and considering the facts and circumstances of the case, this court is inclined to enlarge the petitioner on bail. The above named petitioner is directed to be released on bail in connection with Jalley P.S. Case No. 113 of 2024 on furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned ACJM-I, Darbhanga.
