JUSTICE ANIL KUMAR UPADHYAY ORAL ORDER 06-02-2019 Heard learned counsel for the petitioner and State. The petitioner is in custody in connection with Bheja P.S. Case No. 91 of 2018 for the offence under Sections 341, 323, 324, 307, 354, 379 and 504/34 of the Indian Penal Code. Learned counsel for the petitioner submits that the petitioner has got no criminal antecedent and he is in custody since 03.11.2018. He further submits that there is no specific over act is alleged against the petitioner. He submits that on account of land dispute, scuffle took place, in which both sides have sustained injury and case and counter case was also registered.

Considering the fact that the petitioner has got no criminal antecedent and there is land dispute between the parties as well as case and counter case and also the fact that the

Case No. 91 of 2018.
