The petitioner apprehends his arrest in connection with Patahi P.S. Case No. 190 of 2019 for the offence registered under Sections 323, 324, 325, 341, 307, 379, 447, 504/34 of the Indian Penal Code.

The allegation is regarding the petitioner having assaulted the informant and his uncle by means of iron rod and farsa.

The learned counsel for the petitioner submits that the petitioners has been falsely implicated in the present case and he is having a clean antecedent. It is further submitted that the injury report annexed to the petition as Annexure-2 would show that the injuries are simple in nature.

No.81037 of 2019(2) dt.20-01-2020 2/2 Having regard to the facts and circumstances of the case, considering the submissions of the learned counsel for the petitioner coupled with the fact that the injuries sustained by the injured person are stated to be simple in nature, I deem it fit and proper to grant anticipatory bail to the petitioner herein. Accordingly, the petitioner, above named, is directed to be released on anticipatory bail in the event of his arrest/surrender before the court below within a period of four weeks from today, on furnishing bail bond of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of learned Additional Chief Judicial Magistrate-8th, Motihari in connection with Patahi P.S. Case No. 190 of 2019, G.R. No. 4311 of 2019 subject to the conditions as stipulated under Section 438(2) of the Code of Criminal Procedure. (Mohit Kumar Shah, J) S.Sb/- U T
