The petitioner seeks bail in Bihpur P.S. case No. 254 of 2005 registered under Section 302/34 of the IPC and under Section 27 of Arms Act.
The learned counsel for the petitioner submits that prayer of petitioner for bail was earlier rejected thrice by this court but the trial has not yet been concluded. A report was called for and the learned Additional Sessions Judge-II, Naugachia, who is in seisin of the trial, has reported that evidence of prosecution witnesses has already been closed. The defence evidence has also been closed and now the case is posted for argument. The report is dated 10.05.2019. It appears that the trial itself is likely to be concluded very soon. Considering the facts aforesaid, I am not inclined to
