2. The petitioner apprehends his arrest in a case registered for the offences punishable under Sections 191(2), 190, 126(2), 127(2), 115(2), 117(2), 109(1), 121(1), 121(2), 132, 221 and 352 of the B.N.S.
3. As per prosecution case, 22 named and 8 to 10 unknown accused persons attacked on police party in which police men sustained injuries.
4. Learned counsel for the petitioner submits that petitioner is innocent and has committed no offence. The petitioner was neither present on the spot nor has he participated
Patna High Court CR. MISC. No.84863 of 2025(3) dt.09-02-2026 2/3 in the occurrence. Only on the basis of disclosure statement made by Chaukidar he has been made accused in the case. Moreover, allegation of assault is general and omnibus and no specific accusation of overt act has been alleged against this petitioner. It is further submitted that co-accused Chhotaka Chauhan, having similar and identical allegations, has already been granted the privilege of anticipatory bail by this Hon'ble Court vide order dated 17.01.2026 passed in Cr. Misc. No. 85012 of 2025. Petitioner claims clean antecedents.
5. Learned A.P.P. for the State has vehemently opposed the prayer for grant of anticipatory bail to the petitioner.
6. Considering the facts and circumstances of the case, general and omnibus nature of accusation, claim based on parity and clean antecedents of the petitioner, the prayer for grant of anticipatory bail to the petitioner is allowed.
7. Accordingly, in the event of arrest/surrender within a period of eight weeks from today, let the above named petitioner be enlarged on bail on furnishing bail-bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Judicial Magistrate 1st Class, Nalanda at Biharsharif in connection with Manpur P.S. Case No.
