The petitioner seeks bail in a case instituted for the offences under Sections 147, 148, 149, 341, 307, 124(A) of the Indian Penal Code, 27 of the Arms Act and 17 of C.L.A. Act. The prosecution case in short is that on secret information, when the informant along with police party reached the place of occurrence, the accused persons started opening fire at the police party and taking the benefit of the darkness fled away.

It has been submitted on behalf of the petitioner that the petitioner is in custody since 17.7.2018. There is no allegation of tampering of witnesses alleged against the petitioner. Charge-sheet has been submitted in the present case.

There is no other substantive evidence to suggest the implication of the petitioner in the present case. Other coaccused has been granted bail vide Annexure-2 to the present application.

On behalf of the State, it is submitted that the petitioner is named in the F.I.R.

Considering the aforesaid facts and circumstances, it is directed that the petitioner, above named, be released on bail on furnishing bail bonds of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of learned Additional District & Sessions Judge-III, Aurangabad in connection with STR No. 189/2019/17/2019 arising out of Madanpur P.S. Case No. 9/15.
