JUSTICE ANIL KUMAR UPADHYAY ORAL ORDER 28-01-2019 Heard learned counsel for the petitioner and State. The petitioner is in custody in connection with Bettiah Muffasil (Manuapul) P.S. Case No. 498 of 2018 for the offence under Sections 467, 468, 471, 414 of the Indian Penal Code and 30(a) and 30(B) of the Bihar Prohibition and Excise Act. Learned counsel for the petitioner submits that in relation to theft of motorcycle, search was made at different premises and from the premises of the petitioner 5 litres country made liquor and two motorcycles were seized. He submits that out of two motorcycles, one motorcycle belongs to the petitioner whereas the petitioner denies the ownership of the other motorcycle. He submits that the petitioner has got no criminal antecedent and he is in custody since 16.09.2018.

No.1409 of 2019(2) dt.28-01-2019 2/2 Considering the fact that the petitioner has got no criminal antecedent, the petitioner, named above, is directed to be released on bail on furnishing bail bonds of Rs.10,000/- (Rupees ten thousand) with two sureties of the like amount each to the satisfaction of Special Judge, Excise Act, West Champaran in connection with Muffasil (Manuapul) P.S. Case No. 498 of 2018.
