Learned counsel for the State is present.

The petitioner seeks bail in anticipation of his arrest in connection with Sono P. S. Case No. 204 of 2019 dated 24.07.2019 instituted for the offences under Sections 272, 273 and 290 of the Indian Penal Code and Sections 30(a) and 30(c) of the Bihar Prohibition and Excise Act, 2016.

Three persons were arrested in front of the house of the petitioner who were found to have consumed liquor. The house of the petitioner was raided

Patna High Court CR. MISC. No.83158 of 2019(2) dt.16-12-2019 2/2 and from there, liquor has been recovered. Local persons informed the police party that the petitioner sells liquor from his house.

Considering the afore-noted accusation, I am not inclined to grant anticipatory bail to the petitioner. The prayer for anticipatory bail is rejected. However, should the petitioner surrender before the court below and seeks bail, the court below shall consider it on its own merits and shall pass order in accordance with law, without being prejudiced by the fact that the present petition has not been entertained by this Court.
