None ====================================================== CORAM: HONOURABLE MR. JUSTICE ALOK KUMAR SINHA ORAL ORDER 15-12-2025 Heard learned counsel for the petitioner. Nobody appeared on behalf of Bihar State University Service Commission, Patna.

The petitioner in the present writ application has preyed for grant of following relief :- (i) For directing the respondent authorities to allow the petitioner to compete for the vacant seats against the category of visually impaired under the post of Assistant Professor in the subject of Psychology in terms of the revised circular being published by the respondent commission vide notice dated 14.05.2024 (Anbnexure-P8) wherein a total post of 9 candidates were published under the visually impaired category. (ii) For considering the fact that the final selection list bearing letter no. B.S.U.S.C./Adv-56/2022

Patna High Court CWJC No.20056 of 2025(2) dt.15-12-2025 2/2 (Vol-11)-484 dated 31.05.2024 against the post of total 9 candidates under the visually impaired category only 4 candidates were selected keeping a hope for the petitioner to be selected on the vacant seat. (iii) For considering the fact that the petitioner is a successful candidate being qualified for the interview by surpassing the cutoff generated by the respondent Commission against the selected candidates for the interview vide letter dated 20.01.2023 & 14.05.2024, it was only due to the lapse of communication by the respondent Commission that the petitioner was not able appear for the interview scheduled on 29.01.2023 at 11:00 A.M.

(iv) For directing the respondent authorities to consider the application as in accordance to the rules and procedure framed by the Bihar State University Commission while notifying the Advertisement dated 21.09.2020. "

3. After advancing some argument, learned counsel for the petitioner submits that inadvertently the petitioner could not challenge the final selection list dated 31.05.2024, and therefore, he seeks liberty to withdraw the present writ application with liberty to file fresh writ application challenging the final selection list.

4. As prayed for, this application is dismissed as withdrawn with liberty as prayed for.
