JUSTICE MOHIT KUMAR SHAH ORAL ORDER 11-07-2022 The short prayer made on behalf of the petitioner is to direct the District Magistrate, Patna to pass appropriate orders, after following the directions issued by the learned Court of Divisional Commissioner, Patna vide order dated 26.4.2016, passed in Arms Appeal No. 85 of 2014 whereby the District Magistrate has been directed to seek fresh report from the police authorities, conduct inquiry and then pass appropriate orders.
The learned counsel for the State has submitted that though the application of the
Patna High Court CWJC No.993 of 2019(3) dt.11-07-2022 2/2 petitioner for grant of arms license was rejected by the District Magistrate, Patna vide order dated 28.11.2013, but, since the Divisional Commissioner, Patna, in Arms Appeal No. 85 of 2014, has issued certain directions to the District Magistrate, Patna, the District Magistrate, Patna shall take a fresh decision, in accordance with law. Accordingly, the present writ petition stands disposed of with a direction to the District Magistrate, Patna to take a fresh decision in the case of the petitioner for grant of arms license, after taking into account the directions issued by the Divisional Commissioner, Patna, in his order dated 26.4.2016, within a period of eight weeks of receipt / production of a copy of this order.
