2. The main copy of the supplementary affidavit which has been filed online is taken on record.

3. The petitioner seeks bail in connection with S.Tr. No. 164 of 2023 arising out of Bhagwan Bazar P.S. Case No. 352 of 2022 registered for the offence under Section 302, 120(B)/34 of the Indian Penal Code and under Section 27 of the Arms Act.

4. As per the prosecution case, the petitioner and others are accused of killing the deceased.

5. It has been submitted by the learned senior counsel for the petitioner that the petitioner is innocent and he is in custody since 24.07.2022. He further submits that the petitioner is not the assailant of the deceased and the assailant of deceased is one Vinod Kumar.

6. Learned counsel for the informant has opposed the application of the petitioner by submitting that the trial is on the verge of conclusion.

7. Considering the nature of allegation levelled against the petitioner and also considering the period of custody, this application is allowed.

8. Let the petitioner, above named, be released on bail on furnishing bail bond of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Court of ADJ-IV, Saran at Chhapra/concerned Court below in connection with S.Tr. No. 164 of 2023 arising out of Bhagwan Bazar P.S. Case No. 352 of 2022.

9. As a condition of this order, the petitioner, after being released on bail is directed to co-operate in the trial either by appearing personally or through his lawyer in the trial Court on each and every date fixed by the trial Court. Non-compliance of the condition will result in cancellation of the bail bonds of the petitioner.
