1. Heard the parties.

2. The petitioner apprehends his arrest in connection with Bhagwan Bazar P.S. Case No. 339 of 2024 dated 07.07.2024 registered under Sections 319(2), 336(3), 340(2) of the Bharatiya Nyaya Sanhita 2023.

3. As per the prosecution case on 07.07.2024 during the course of examination of CTET-2024, Centre Superintendent of the examination found that two persons were taking the examination in place of the petitioner and the co-accused: Nitu Kumari and they were taken into custody.

4. Learned counsel for the petitioner submits that as per the first information report Hareram Pandey was appearing in the

No.4203 of 2025(2) dt.07-03-2025 2/3 examination for the petitioner by tampering the photograph and as per report of the Centre Superintendent the photograph of two examinees were not matching with the photograph of the petitioner and others. The persons who were impersonating the petitioner and the co-accused were taken into custody. The petitioner was not aware about the examination having been taken by the co-accused / Hareram Pandey inasmuch as the petitioner was working somewhere else and he did not get leave from his job.

Regard being had to the submission made by the parties, taking into consideration the nature of allegation and the fact that the person impersonating the petitioner has been taken into custody in the examination hall, as such, I am inclined to grant anticipatory bail to the petitioner subject to the condition that he shall not repeat the offence in future.

6. Let the petitioner, above named, be released on anticipatory bail in the event of arrest or surrender before the court below within a period of four weeks from today on furnishing bail bond of Rs. 10,000/- (rupees ten thousand) with two sureties of the like amount each to the satisfaction of Additional Chief Judicial Magistrate-I, Saran at Chapra in connection with Bhagwan Bazar P.S. Case No. 339 of 2024
