2. This application, for grant of regular bail, arises out of L.N.M.U. Police Station Case No. 91 of 2023, registered for the offence punishable under Section 304(B)/34 of the Indian Penal Code.

3. As per the prosecution case, the informant got remarried with the petitioner after her husband abandoned her. The allegation against the petitioner is that he has killed the deceased.

4. Learned counsel for the petitioner submits that the petitioner is in jail since 26.06.2023. It has also been submitted that from the post-motem report (Annexure-2), it appears that

No.2804 of 2024(2) dt.24-01-2024 2/2 there is no ante-mortem injury and he has further submitted that the deceased had committed suicide because she received information from her family members to her second marriage. Independent witnesses have said that the deceased has committed suicide.

5. Considering the aforesaid facts, this application is allowed.

6. Let the petitioner, above named, be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned A.C.J.M.,-III, Darbhanga, in connection with L.N.M.U. Police Station Case No. 91 of 2023.
