The petitioner is apprehending his arrest in connection with Complaitn Case No.938-C/2016 registered for offences punishable under Sections 498A of the Indian Penal Code. Allegation against the petitioner that is of subjecting his wife of cruelty and harassment with respect of demand of dowry.

Submission of the learned counsel for the petitioner is that the marriage was solemnized 10 years earlier as well as they have three children. He is ready to keep her. Heard learned A.P.P. also.

Having heard both sides and in view of the facts and circumstances, as stated above, this application is disposed of with direction to the petitioner to surrender before the learned

Patna High Court Cr.Misc. No.1187 of 2019(2) dt.17-01-2019 2/2 court below within a period of six weeks from the date of order and on surrender he will be released on provisional bail for a period of three months in connection with Complaint Case No.938-C of 2016, in the meantime, the learned court below shall issue notice to the complainant and try to reconcile the matter and if the petitioner is not found at any fault, he will confirm the bail bond of the petitioner; otherwise he is free to pass any other order or orders, as he deems fit and proper. . With the aforesaid observation, this application is disposed of.
