1. Heard learned counsel for the parties.

2. The petitioner has preferred this application for grant of regular bail in connection with Raniganj P.S. Case no. 436 of 2023, registered under section 30(a) of the Bihar Prohibition and Excise Act, 2016.

3. As per the prosecution case, 444 litres of IMFL was recovered and the petitioner and one Pintu Paswan were arrested at the spot. Other accused persons managed to escape.

4. Learned counsel for the petitioner submits that the petitioner has been falsely implicated in the case because of his antecedents. No incriminating article has been recovered from the petitioner's possession. He has no concern with the seized articles or the vehicle in question from which it was allegedly seized. Co-accused Pintu Paswan has been enlarged on bail vide

Patna High Court CR. MISC. No.1427 of 2024(2) dt.18-01-2024 2/2 order dated 12.1.2024 passed in Cr. Misc. no.86560 of 2023. The petitioner is in custody since 15.11.2023.

5. The application for bail is opposed by learned APP for the State.

6. Having heard learned counsel for the parties and taking into consideration the allegations in the FIR, grant of bail to co-accused Pintu Paswan and the petitioner having remained in custody since 15.11.2023, the petitioner is directed to be enlarged on bail in connection with Raniganj P.S. Case no. 436 of 2023, on furnishing bail bond of Rs.10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Exclusive Special Judge Excise-I, Araria.
