JUSTICE ASHUTOSH KUMAR ORAL ORDER 17-03-2020 The petitioner, who is in custody since 06.04.2019, seeks bail in connection with Sessions Trial No. 458 of 2019 arising out of Ishipur Barahat P.S. Case No. 32 of 2019, dated 05.04.2019, instituted for the offences under Sections 395, 397 and 120B of the Indian Penal Code.

The petitioner is not named in the F.I.R. and his name has transpired in the confession of a co-accused person. There is no incriminating recovery from the

Patna High Court CR. MISC. No.78889 of 2019(3) dt.17-03-2020 2/2 possession of the petitioner and in one case in which he was earlier made accused, he is on bail.

Considering the facts aforestated, the petitioner above-named is directed to be released on bail on his furnishing bail bonds in the sum of Rs. 10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of learned 7th Addl. District and Sessions Judge, Bhagalpur in connection with Sessions Trial No. 458 of 2019 arising out of Ishipur Barahat P.S. Case No. 32 of 2019.

The application stands allowed.
