2. Petitioners apprehend arrest in a case registered for the offences punishable under Sections 191(2), 191(3), 190, 126(2), 115(2), 103(1) of the Bharatiya Nyaya Sanhita.

3. As per prosecution case, these petitioners along with other F.I.R. named accused persons brutally assaulted the brother of informant by means of lathi, spears and axes as a result of which, he succumbed to the injuries.

4. Learned counsel for the petitioners submits that petitioners are cousin brother of the deceased and due to petty

No.2282 of 2025(3) dt.15-04-2025 2/2 dispute between the parties, Panchayat was called for which eventually failed and later, on the alleged date, an alteration took place between the parties in which the deceased died. Allegation of assault is general and omnibus and there is no specific allegation of overt act against these petitioners. Petitioners claim clean antecedent.

5. Learned counsel for the informant vehemently opposed the bail application and submitted that petitioners are named in the F.I.R. with specific accusation of assaulting the brother of informant. Post-mortem report reveals multiple injuries on the body of deceased.

6. Considering the nature of accusation and gravity of the offence, prayer for bail of the petitioners is refused. (Prabhat Kumar Singh, J) Navya/- U T
