====================================================== CORAM: HONOURABLE MR. JUSTICE PRABHAT KUMAR SINGH ORAL ORDER 17-02-2026 Heard learned counsel for the petitioners and the State.

2. Petitioners apprehend arrest in a case registered for the offences punishable under Sections 191(2), 190, 126(2), 115(2), 118(1), 303(2), 74, 109, 352, 351(2) of the Bharatiya Nyaya Sanhita.

3. As per prosecution case, on 24.07.2025, all the F.I.R. named accused persons, including these petitioners, put obstruction on the way of informant and upon protest, informant and his family members were assaulted by means of lathi,

Patna High Court CR. MISC. No.85098 of 2025(3) dt.17-02-2026 2/3 danda, iron rod. It is further alleged that the accused persons also snatched Mangalsutra, earrings of the wife of informant.

4. Learned counsel for the petitioners submits that petitioners are innocent and have committed no offence. As a matter of fact, on account of land dispute, a free fight took place between the parties in which both sides inflicted injuries on each other. Case and counter case. Allegation of assault is general and omnibus and there is no allegation of any specific overt act against these petitioners. Rest of the allegations are ornamental only to make the case grave. Similarly situated co-accused persons have already been granted anticipatory bail by coordinate Bench of this Court vide order dated 26.11.2025 passed in Cr. Misc. No. 76087 of 2025.

5. Learned A.P.P. for the State vehemently opposed the bail application.

6. Considering the nature of accusation, case and counter case and other facts and circumstances of the case, this anticipatory bail is allowed and it is ordered that let the above named petitioners in the event of their arrest/surrender before the court below within a period of eight weeks from today, be enlarged on bail on furnishing bail-bond of Rs. 10,000/- (ten thousand) each with two sureties of the like amount each to the

Patna High Court CR. MISC. No.85098 of 2025(3) dt.17-02-2026 3/3 satisfaction of Chief Judicial Magistrate, Vaishali (Hajipur) in connection with Hajipur Sadar P. S. Case No. 610 of 2025, subject to condition as laid down under Section 482(2) of the Bharatiya Nagarik Suraksha Sanhita, 2023.
