JUSTICE VINOD KUMAR SINHA ORAL ORDER 31-01-2019 This is an application for grant of anticipatory bail in connection with Sonepur P.S. Case No. 373 of 2018, disclosing offences under Sections 304(B), 201, 498(A)/34 of the Indian Penal Code and Section 3⁄4 of the Dowry Prohibition Act. Allegation against the petitioners, who happens to be sister-in-law and brother-in-law of the deceased, is of causing dowry death of the deceased.
Submission of learned counsel for the petitioners is that there is no specific allegation has been attributed against them and the whole family members have made accused in this case. Further, they have no criminal antecedents. Heard learned A.P.P. also, who opposed the prayer for
Patna High Court Cr.Misc. No.80027 of 2018(3) dt.31-01-2019 2/2 anticipatory bail of the petitioners stating that the death has occurred within two months of marriage.
Having heard both sides, considering the above submission, this application is allowed. Let the petitioners, above named, in the event of their arrest or surrender before the court below within six weeks, be released on bail on furnishing bail bond of Rs. 25,000/- (Rupees Twenty Five Thousand) each with two sureties of the like amount each to the satisfaction of learned A.C.J.M.-1st Saran at Chapra, in connection with Sonepur P.S.
