2. Petitioner apprehends arrest in a case registered for the offences punishable under Sections 384, 385, 386 of the Indian Penal Code.

3. As per prosecution case, this petitioner is alleged to have taken money from the husband of informant to get release the son of informant from police custody who was brought to Rajepur police station for questioning as a suspect in Rajepur P. S. Case No. 78 of 2024.

4. Learned counsel for the petitioner submits that petitioner is innocent and has committed no offence. As a matter of fact, petitioner has contested in Zila Parishad Election as a

Patna High Court CR. MISC. No.89524 of 2024(2) dt.21-01-2025 2/2 candidate due to which he has falsely been implicated in this case as conspiracy. F.I.R. has been lodged after inordinate delay of 37 days without any plausible explanation and there is no chit of paper on record to support the allegation levelled against the petitioner.

5. Learned A.P.P. for the State as well as learned counsel for the informant vehemently opposed the bail application.

Considering the aforesaid facts and circumstances of the case, this anticipatory bail is allowed and it is ordered that let the above named petitioner in the event of his arrest/surrender before the court below within a period of eight weeks from today, be enlarged on bail on furnishing bail-bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of Judicial Magistrate, 1st Class, Motihari in connection with Rajepur P. S. Case No. 114 of 2024, subject to condition as laid down under Section 438(2) of the Code of Criminal Procedure.
