2. Petitioner apprehends arrest in a case registered for the offence punishable under sections 25 (1-b)/a/26 of Arms Act.

3 . As per the prosecution case , there was heated verbal exchange between the petitioner and the informant over a trivial issue and thereafter, it is alleged that this petitioner snatched arms and other articles from informant.

4. Learned counsel for the petitioner submits that in morning of the alleged date of the occurrence , brother of the petitioner was murdered in which petitioner is eye witness, for which hot talk took place betwen the family members of

No.89517 of 2024(3) dt.05-02-2025 2/2 petitioner and SHO Sahar for not taking appropriate action against accused persons and in retaliation , this false and concocted case has been lodged against this petitioner. No incriminating article has been recovered from the conscious possession of the petitioner. Petitioner claims clean antecedent. 5 . Learned counsel for the State opposes the bail petition of the petitioner.

6. Considering the aforesaid facts, clean antecedent of the petitioner and other circumstances of the case , in the event of arrest or surrender within eight weeks from today, let the petitioner, as named above, be enlarged on bail on furnishing bail bond of Rs.10,000/-(ten thousand) with two sureties of the like amount each to the satisfaction of the learned Judicial Magistrate Bhojpur at Ara in connection with Sahar P.S. case No. 167 of 2024 , subject to the conditions laid down under section 482 ( 2 ) of BNSS 2023 .
