2. In this case, the petitioner is seeking regular bail in connection with Dumraon (Naya Bhojpur O.P.) P.S. Case No. 149 of 2022, registered for the offences punishable under Section 412 of the Indian Penal Code and Sections 25(1-b)a, 26 and 35 of the Arms Act.

3. Learned counsel for the petitioner has submitted that vide order dated 23.02.2024 in Cr. Misc. No. 7121 of 2024, this Court has observed that if the trial is not concluded within a period of nine months, the petitioner may renew his prayer for bail. He has further submitted that more than one year has elapsed but still the trial has not been concluded.

Learned counsel has submitted further that coaccused, Bablu Yadav @ Bablu Kumar Yadav has been granted bail and the case of the petitioner is on better footing because no arms and ammunition was recovered from possession of the petitioner and only a cash of Rs. 50,000/- and mobile set were recovered whereas one country made pistol and a cash of Rs. 1 lakh was recovered from possession of co-accused, Bablu Yadav @ Bablu Kumar Yadav. The petitioner is under custody since 24.03.2022.

5. On the other hand, learned APP for the State opposes the prayer for bail of the petitioner.

Considering the above-mentioned facts and circumstances, the petitioner, above-named be released on bail on furnishing bail bonds of Rs.10,000/- with two sureties of the like amount each to the satisfaction of learned District Additional and Sessions Judge II, Buxar in connection with S. Tr. No. 27 of 2023 arising out of Dumraon (Naya Bhojpur O.P.) P.S. Case No. 149 of 2022, subject to the following condition that the petitioner shall cooperate in the disposal of trial and make himself available as and when required by the court.

7. The petitioner shall remain physically present on each and every date till conclusion of the trial and on his
