This application for grant of anticipatory bail arises out of Sandesh P. S. Case No. 38 of 2019 registered for the offence punishable under Sections 341, 307 and 504/34 of the Indian Penal Code.

Learned counsel appearing on behalf of the petitioner, referring to the First Information Report has submitted that petty dispute between the parties appears to have been the reason behind the occurrence and lodging of the First Information Report. He has submitted that there is specific allegation against co-accused Satish Rai of having opened fire leading to firearm injury sustained by the informant. He contends that similarly circumstanced co-accused Abhishek Kumar @ Abhishek Kumar Rai has been allowed anticipatory bail by this Court by an order

Patna High Court CR. MISC. No.83822 of 2019(3) dt.03-07-2020 2/2 dated 30.08.2019 passed in Cr. Misc. No. 54567 of 2019. Considering the facts and circumstances, this application is allowed.

Let the petitioner above named, in the event of his arrest/surrender within six weeks from today in the Court below, be released on bail on furnishing bail bond of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned J.M. 1st Class, Bhojpur at Ara, in Sandesh P.S. Case No. 38 of 2019, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure.

This is subject to the condition that the petitioner shall present himself before the Police/Court, as the case may be, as and when required and in the event of failure on his part to appear before the Court on two consecutive occasions, his bail bonds shall be liable to be cancelled.
