2. The petitioner has prayed for regular bail in a case instituted for the offence under Sections 467, 468, 471, 419, 420 of the Indian Penal Code.
3. The allegation against the petitioner is of preparing forged and fabricated rent reciept, L.P.C. and to obtain fraudulently crop compensation and land acquisition of the informant's land from GAIL company.
4. It is submitted by learned counsel for the petitioner that petitioner has been falsely implicated in this case. He has

He submitted that petitioner is legal owner of the Khata No. 367, Plot No. 577, Area 15 decimal because that land in the name of Ganesh Mallah, who is grandfather of the petitioner and that land was in the peaceful possession of the petitioner and government rent also paid the petitioner till 2022. He submitted that on 24.12.2018 learned A.D.M., Nalanda ordered to cancel the Jamabandi No. 133/227 of the petitioner without proper verification of the relevant paper/documents without using judicial mind, then petitioner filed an appeal before the Court of the District Magistrate, Nalanda on 08.02.2019, Jamabandi cancellation Case No. 22 of 2019, which is pending for hearing till today. He further submitted on the basis of Government record Khatiyan and Jamabandi, Circle Officer Sarmera and Halka Karmchari issued the L.P.C. is not forged or illegal. He is languishing in judicial custody since 25.08.2023.
5. The application for bail is opposed by learned APP for the State.
6. Having heard learned counsel for the parties and considering the facts and circumstances of the case as well as period of custody, this court is inclined to enlarge the petitioner on bail. The above named petitioner is directed to be enlarged
Patna High Court CR. MISC. No.3774 of 2024(2) dt.01-02-2024 3/3 on bail on furnishing bail bond of Rs. 10,000/- (Rs. ten thousand only) with two sureties of the like amount each to the satisfaction of the learned Court concerned in connection with Sarmera P.S. Case No. 158 of 2023.
