1. Heard the parties.

2. The petitioner apprehends his arrest in connection with Kopa P.S. Case No. 186 / 2023 dated 06-09-2023 registered under Section 30 (a) of the Bihar Prohibition and Excise Act 2018.

3. As per the First Information Report the Police intercepted an Alto vehicle, in which two persons were sitting, and upon seeing the Police party both of them succeeded in fleeing away. A total quantity of 130.5 litres of illicit liquor was recovered from the said car.

4. Learned counsel for the petitioner submits that the petitioner has falsely been implicated in this case and the Police has dragged the name of the petitioner along with the co-accused in this case on the basis of mobile phone kept in the seized car. He further submits that the petitioner is the driver of

Patna High Court CR. MISC. No.86591 of 2023(2) dt.24-01-2024 2/2 the vehicle in question and was not aware about the illicit liquor kept therein at the behest of the owner. He next submits that the co-accused said to be the owner of the said car has been granted anticipatory bail by a Co-ordinate Bench of this Court in Cr. Misc. 75753 / 2023.

5. Regard being had to the submission made by the parties, taking into consideration the fact that the co-accused has been granted anticipatory bail by a Co-ordinate Bench of this court, as such, I am inclined to grant anticipatory bail to the petitioner.

6. Let the petitioner, above named, be released on anticipatory bail in the event of arrest or surrender before the court below within a period of four weeks from today on furnishing bail bond of Rs. 10000/- (rupees ten thousand) with two sureties of the like amount each to the satisfaction of 3rd Exclusive Special Excise Judge, Saran at Chapra in connection with Kopa P.S. Case No. 186 / 2023 subject to the condition as laid down under Section 438 (2) of the Cr.P.C. praful/- (Anil Kumar Sinha, J) U T
