The petitioner seeks regular bail in Siwan Muffasil P.S. Case No. 607/2018, registered for the offences punishable under Section 272 and 273 of the Indian Penal Code and section 30(a) of the Bihar Prohibition & Excise Act.

It is alleged in the written report that 3.75 litres of foreign liquour was recovered from the straw house of this petitioner.

Learned counsel for the petitioner has submitted that petitioner is in custody since 30.10.2018.

Considering the facts and circumstances of the case, prayer of the petitioner for grant of bail is allowed. Let the petitioner above-named, be released on bail on furnishing bail

Patna High Court Cr.Misc. No.80776 of 2018(2) dt.18-01-2019 2/2 bond of Rs. 10,000 (Ten thousand) with two sureties of the like amount each to the satisfaction of the learned Additional District & Sessions Judge Iind-cum-Special Judge Excise, Siwan in connection with Siwan Muffasil P.S. Case No. 607/2018, subject to the condition that both the bailors will be close relative of the petitioner.

From para 3 of the bail petition it appears that petitioner is accused in another case of Excise Act. The petitioner will file affidavit at the time of filing bail bond in the court below that he would not indulge himself in such type of activity in future. In the event he is found indulged in such type of activity, his bail bond in instant case will liable to be cancelled.
