1. Heard learned counsel for the petitioner and learned A.P.P. for the State.
2. The petitioner seeks bail in connection with Pandarak P.S. Case No. 127/2021, G.R. No.1667/2021 registered under sections 498(A), 363, 364, 34 of the Indian Penal Code and Sections 3⁄4 of the D.P. Act.
3. The learned counsel submits that petitioner is a person with clean antecedent and has been falsely implicated in the instant case by the informant and is in custody since 02.08.2023. It is further submitted that the petitioner is husband of the deceased. The learned counsel next draws the attention of the Court to order dated 25.08.2023 in Cr. Misc. No.54471/2022 to submit that in the said case, the relative of the present petitioner had approached this court seeking anticipatory bail in the instant case instituted by the informant, when this court had directed the S.S.P., Patna to
Patna High Court CR. MISC. No.2132 of 2024(4) dt.10-04-2024 2/2 investigate the matter personally and when the S.S.P., Patna took interest in the case, it transpired that the deceased had died at her parental home and the family members of the deceased were aware of her death but still they instituted a false and a misleading F.I.R. alleging that the victim was missing. The learned counsel thus submits that the facts of the case has been taken note of by this court in detail in Cr. Misc. No.54471/2022 and the same was allowed by an order dated 25.08.2023.
4. The learned APP opposes the bail application of the petitioner.
5. Considering the submissions and taking into consideration the order dated 25.08.2024 in Cr. Misc. No.54471/2022, the petitioner above-named, is directed to be released on bail on furnishing bail bonds of Rs.10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned A.C.J.M.-1st, Barh, Patna in connection with Pandarak P.S. Case No. 127/2021, G.R. No.1667/2021. (Satyavrat Verma, J) amit/- U T
