The petitioners seek regular bail in connection with Excise Case No. 726 of 2019 for the offence punishable under Sections 30(a) of the Bihar Prohibition and Excise Act, 2018. The allegation is regarding recovery of 30 liters of illicit liquor from a motorcycle, which was being driven by the petitioners herein.
The learned counsel for the petitioners has submitted that the petitioners have been falsely implicated in the present case and are languishing in custody since 16.11.2019. Having regard to the facts and circumstances of the
Patna High Court CR. MISC. No.79266 of 2019(2) dt.13-01-2020 2/2 case and considering the submissions made by the learned counsel for the petitioners, I deem it fit and proper to direct for release of the petitioners on regular bail.
Accordingly, the petitioners, above named, are directed to be enlarged on regular bail on furnishing bail bonds of Rs. 10,000/- each with two sureties of the like amount each to the satisfaction of learned Special Excise Judge, Gaya in connection with Excise Case No. 726 of 2019.
