====================================================== CORAM: HONOURABLE MR. JUSTICE PRABHAT KUMAR SINGH ORAL ORDER 15-04-2025 Heard learned counsel for the petitioners and the State.

2. Petitioners apprehend arrest in a case registered for the offences punishable under Sections 467, 468, 420, 406 of the Indian Penal Code.

3. As per prosecution case, these petitioners established a fake company named ACO99 Pvt. Ltd. and lured informant into investing Rs. 17 lacs by promising high returns but when informant demanded his money back, these petitioners failed to return the same.

4. Learned counsel for the petitioners submits that

Patna High Court CR. MISC. No.3056 of 2025(3) dt.15-04-2025 2/3 petitioners are innocent and have committed no offence. Petitioners are neither agents nor employees of the aforesaid company and apart from the informant, not a single person has claimed to have invested money in the alleged company. It is further submitted that petitioner No. 1 is of unsound mind and taking advantage of the same, Rs. 2,60,000/- were deposited in his bank account without any knowledge which were immediately returned by petitioner No. 1 and in this regard informant has also given a written acknowledgment on 23.01.2024. Moreover, it is a case of civil nature. Petitioners claim clean antecedent.

5. Learned A.P.P. for the State vehemently opposed the bail application.

Considering the aforesaid facts and circumstances of the case, this anticipatory bail is allowed and it is ordered that let the above named petitioners in the event of their arrest/surrender before the court below within a period of eight weeks from today, be enlarged on bail on furnishing bail-bond of Rs. 10,000/- (ten thousand) each with two sureties of the like amount each to the satisfaction of Judicial Magistrate, 1st Class, Saran at Chapra in connection with Derni Bazar P. S. Case No. 56 of 2024, subject to condition as laid down under Section
