1. Heard learned Counsel for the petitioner and learned Additional Public Prosecutor for the State.
2. This application, for grant of anticipatory bail, arises out of Bachchwara Police Station Case No. 292 of 2024, disclosing offences under Sections 115(2), 126, 109, 352, 351(2), 351(4), 3(5) of the BNS, 2023.
3. As per the FIR, on 25.07.2024, while the informant came back after withdrawing Rs. 10,000/- from UCO Bank, the co-accused Bindu Devi came at her house and asked for Rs. 5,000/- to which the informant denied. It has further been alleged that in the evening at about 6:00 pm, all the accused persons including the petitioner arrived and questioned the informant that why the money was not given to her mother and upon protest by the informant, the petitioner assaulted the
Patna High Court CR. MISC. No.3229 of 2025(2) dt.20-02-2025 2/3 informant on her head due to which she sustained head injury. When the informant's son and daughter came to rescue, coaccused assaulted them also.

Learned Counsel for the petitioner submits that both the parties are neighbors and the occurrence has taken place on the trivia issue of demand of money from the informant by the side of the petitioner. The injuries caused to the informant as discussed in the impugned order are simple in nature. Other victims who have sustained injuries, their injuries are also simple in nature. The petitioner is having no criminal antecedent.
5. Having regard to the submissions made on behalf of the parties and taking into consideration the fact that both the parties are neighbors, the injuries caused to the informant are simple in nature, I am inclined to grant the petitioner privilege of anticipatory bail.
6. This application is, accordingly, allowed.
7. Let the petitioner, above named, in the event of his arrest or surrender before the Court below within four weeks, be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Begusarai, in
Patna High Court CR. MISC. No.3229 of 2025(2) dt.20-02-2025 3/3 connection with Bachchwara Police Station Case No. 292 of 2024, subject to the condition laid down under Section 438 (2) of the Code of Criminal Procedure.
