2. The petitioner apprehends arrest in a case registered for the offence punishable under sections sections 8(b), 18(b), 20(b) (ii) (c) and 29 of the NDPS Act and other allied sections of the Indian Penal Code.
3. As per the prosecution case, petitioner and other accused persons were found cultivating opium in the field.
4. Learned counsel appearing for the petitioner submits that the allegation is vague as no description of filed has been given on which opium was cultivated. Moreover, petitioner is land less and co-accused, with similar allegation, has already been allowed pre-arrest bail by a co-ordinate bench of this Court vide paragraph 15. Petitioner claims clean antecedent.
5. Considering the aforesaid facts of the case, prayer
Patna High Court CR. MISC. No.9934 of 2024(3) dt.16-04-2024 2/2 for bail of the petitioner is allowed. In the event of arrest/surrender within six weeks from today, let the petitioner, mentioned above, be enlarged on bail on furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the Special Judge, NDPS Court cum Additional Sessions Judge I, Aurangabad in Madanpur Police Station Case No. 64 of 2023, subject to the conditions laid down under section 438(2) of the Code of Criminal Procedure.
