2. The petitioner seeks bail in connection with Bikram P.S. Case No. 376 of 2024 registered for the offences under Section 96 of BNS.
3. The allegation against the petitioner is that he, in the early morning of 04.09.2024, had taken away the minor daughter of the informant along with the gold and silver ornaments with the purpose of marriage.
4. Learned counsel for the petitioner submits that the petitioner is innocent and has falsely been implicated in this case. There was a love affair between the petitioner and the victim girl and the victim girl had gone along with the petitioner

The learned counsel for the petitioner has drawn the attention of this Court towards para no. 37 of the case diary wherein it has been mentioned that the Aadhar of the victim girl was submitted by the prosecution side and it was found that the date of birth of the victim girl was 31.10.2005. The learned counsel further draws the attention of this Court that the victim girl had refused for medical examination and in her 180 BNSS statement she has categorically stated that she had gone with the petitioner out of her own sweet will and she had even married the petitioner in a temple. Learned counsel has lastly submitted that the petitioner has clean antecedent and he is in custody since 09.10.2024.
5. The learned Additional Public Prosecutor for the State and learned counsel for the informant have opposed the prayer for bail and submit that the petitioner has kidnapped a minor girl for the purpose of marriage.

Considering the aforesaid submissions and taking into account the statement of the victim girl before the police and also the fact that the petitioner is in custody since 09.10.2024, let the petitioner, above named, be enlarged on bail on furnishing bail bond of Rs.10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the
Patna High Court CR. MISC. No.89043 of 2024(5) dt.08-05-2025 3/3 learned A.C.J.M-VI, Danapur in connection Bikram P.S. Case No. 376 of 2024 subject to the conditions that a. The petitioner shall remain physically present in Court on each date of the trial.
b. In case of absence on two consecutive dates, or in violation of the terms of the bail and in case the learned Trial Court is of the opinion that the trial is being delayed due to non-cooperation on part of the petitioner, the learned Trial Court may cancel the bail bond of the petitioner and take him into custody till conclusion of the trial.
