JUSTICE ANIL KUMAR UPADHYAY ORAL ORDER 16-01-2019 Heard learned counsel for the petitioner and State. The petitioner is in custody in connection with Soh Sarai P.S. Case No. 240 of 2018 for the offence under Sections 30(a) and 38 of the Bihar Prohibition and Excise Act, 2016. Learned counsel for the petitioner submits that the petitioner has got no criminal antecedent and he is in custody since 29.11.2018. He further submits that in the instant case 45 litres country made liquor was recovered from the motorcycle. He submits that the petitioner has no concern either with the business of liquor or with Mukesh Kumar, who has been made accused in the instant case.

Considering the fact that the petitioner has got no criminal antecedent, the petitioner, named above, is directed to be released on bail on furnishing bail bonds of Rs.10,000/-

Patna High Court Cr.Misc. No.528 of 2019(2) dt.16-01-2019 2/2 (Rupees ten thousand) with two sureties of the like amount each to the satisfaction of 6th Additional Sessions Judge-cum- Special Judge, Excise, Nalanda at Biharsharif in connection with Soh Sarai P.S. Case No. 240 of 2018.
