JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 28-03-2019 Heard learned counsel appearing for the petitioner as well as learned counsel appearing for the prosecution. Petitioner seeks bail in a case registered for the offences punishable under Sections 406, 420/34 of the Indian Penal Code.
The petitioner was Assistant Godown Manager and he gave information to the District Manager, Bihar State Food Corporation, Saran at Chapra on 22.09.2018 regarding nonsupply of C.M.R. by concerned PACS and about fake entries in computer system and other documents made by co-accused, Vidyanand Prasad Singh. The enquiry was conducted and after completion of enquiry, the present case was lodged on the
Patna High Court CR. MISC. No.3157 of 2019(3) dt.28-03-2019 2/2 direction of District Magistrate against the petitioner and aforesaid Data Entry Operator Vidyanand Prasad Singh. Submission on behalf of the petitioner is that it was petitioner who gave information in respect of the alleged occurrence but senior officials to save their skin made the petitioner accused in this case. He further submitted that moreover, investigation against the petitioner has already been completed and except suspicion, nothing has been brought against the petitioner in course of investigation. Considering the aforesaid facts and circumstances as well as submissions of the parties, let the petitioner, above named, be released on bail on furnishing bail bonds of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Chapra in connection with Chapra Mufassil P.S. Case No. 401 of 2018.
