2. This is an application for regular bail on behalf of the petitioner for the offences alleged under Sections 338, 336 (3), 340(2) and 3(5) of the BNS including Sections 25(1b)a, 26 and 35 of the Arms Act, registered in connection with Jamhore P.S.Case No. 205/2024.
3. According to prosecution, the informant, who was an ASI of Jamhore Police Station, received an information and on the basis of that information, he raided the place of occurrence, where five persons were present carrying bags. On being signalled to stop, three persons succeeded in fleeing away and two persons, the petitioner and one Uttam Kumar were
Patna High Court CR. MISC. No.86914 of 2025(2) dt.12-12-2025 2/2 arrested. From the trolley bag of the petitioner, 320 live cartridges were recovered.
4. The learned counsel for the petitioner has submitted that the petitioner is innocent and has falsely been implicated. It is further submitted that two co-accused persons have been granted bail.
5. On the other hand, the learned APP for the State has opposed the prayer for bail. He submits that the petitioner was arrested at the spot and a huge quantity of ammunition was recovered from a trolley bag carried by the petitioner.
6. Since the petitioner has criminal history of similar nature of cases, he does not deserve the privilege of bail, which is hereby rejected.
