The petitioner seeks bail in connection with Udawant Nagar (Gajrajganj) P.S. Case No. 444 of 2018 registered under Section 30(a) of Bihar Prohibition and Excise Act.
50 lts. of country made liquor is said to have been recovered from a motorcycle and petitioner and one other accused, namely, Golu Keshri were apprehended. It is submitted by learned counsel for the petitioner that no incriminating article has been recovered from conscious physical possession of the petitioner. He has no concern either with the seized liquor or with the motorcycle in
Patna High Court Cr.Misc. No.79999 of 2018(2) dt.18-01-2019 2/2 question. He was simply travelling on the said motorcycle by taking lift from its owner without any knowledge of keeping of liquor on the said motorcycle. He has no criminal antecedent and has been languishing in custody since 12.11.2018. Learned APP opposed the bail prayer of the petitioner.
In the facts and circumstances of the case, the above named petitioner is directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of the learned Special Judge, Excise, Bhojpur Ara in connection with Udawant Nagar (Gajrajganj) P.S.
