The petitioner is in custody since 26.11.2018 in connection with Kadamkuan P.S. Case No.402 of 2018 registered for the offence under Sections 420, 379, 34 and 395 of the Indian Penal Code.
Learned counsel for the petitioner submits that there was some dacoity committed in the jewellery shop of the informant and it was alleged that two persons stating to be the police officers had conducted the raid in their premises, but later on it was found that they were imposters and therefore the case was lodged. Learned counsel for the petitioner submits that though the petitioner is not named in the F.I.R., subsequently, in
Patna High Court Cr.Misc. No.80252 of 2018(2) dt.30-01-2019 2/2 the confessional statement made before the police by one Manoj Kumar alias Manoj Verma, the name of the petitioner has surfaced. It is further submitted that another person, namely, Ved Nidhi, who has also been named by the said Manoj Kumar, has also been extended the privilege of bail in Cr.Misc. No.60207 of 2018, vide order dated 05.11.2018. The said Manoj Kumar has also been extended the privilege of bail in Cr.Misc. No.64459 of 2018, vide order dated 05.11.2018. In view of the aforementioned facts and circumstances and that the similarly situated persons have been extended the privilege of bail, let the petitioner, above named, be released on bail on his furnishing bail bond of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of the learned Sub-Judge-VII-cum-Additional Chief Judicial Magistrate, Patna, in connection with Kadamkuan P.S. Case No.402 of 2018.
