2. The petitioner is in custody since 10.11.2023 in connection with Sheikhpura (Sirari O.P.) P.S. Case No. 739/2023 registered for the offence punishable under Sections 25(1-b)a/26 of the Arms Act.

3. As per the prosecution case, one countrymade pistol and five live cartridges have been recovered from the house of the petitioner.

4. Learned counsel for the petitioner submits that the petitioner has been falsely implicated in this case. He further submits that nothing incriminating has been recovered from the possession of the petitioner. The petitioner has no criminal antecedents.

5. Learned Additional Public Prosecutor appearing on behalf of the State has vehemently opposed the prayer for bail.

6. Considering the facts and circumstances of the case, let the petitioner above named be released on bail, on furnishing bail bonds of Rs.10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Sheikhpura in connection with Sheikhpura (Sirari O.P.) P.S. Case No. 739/2023.

7. The petitioner is directed to mark his attendance in Sheikhpura P.S. on 1st Sunday of every month failure to do so, will result in cancellation of bail bond of the petitioner. (Sandeep Kumar, J) Saif/- U T
