The petitioner apprehends his arrest in connection with Rajaun P.S. Case No. 160 of 2019 for the offence registered under Sections 379 and 411 of the Indian Penal Code, Sections 40 (8) of BNNC Rule, 1972, Section 21(1) (4) of MMDR Act, 1952 and Section 8(a) of Bihar Minerals Prevention of Illegal Minerals and Transportation and Storage Rule, 2003.

The allegation is regarding the petitioner being engaged in the business of smuggling sand which is a controlled item under the provisions of Bihar Minor Mineral Concession Rules, 1972.

Having regard to the facts and circumstances of the case, the petitioner, above named, is directed to be released on anticipatory bail in the event of his arrest/surrender before the court below within a period of four weeks from today, on furnishing bail bond of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Banka in connection with Rajaun P.S. Case No. 160 of 2019 subject to the conditions as stipulated under Section 438(2) of the Code of Criminal Procedure. (Mohit Kumar Shah, J) S.Sb/- U T
