The petitioner is apprehending his arrest in connection with Khagaria (Muffasil) P.S.Caase No.518 of 2019 registered for offences punishable under Sections 406, 420, 504, 506 of the Indian Penal Code.

As per prosecution case on the persuasion of the petitioner, the informant deposited altogether Rs.38,000/- in the installment of Rs.1,500/- per month and he has also collected money from the others and thereafter he is not returning the same and thus cheated large number of persons . A complaint was lodged by the informant and several other persons. Submission of the learned counsel for the petitioner is

Patna High Court CR. MISC. No.79372 of 2019(2) dt.20-01-2020 2/2 that he is not agent of the company rather his wife is the agent and he has falsely been implicated in this case . Heard learned A.P.P. who has opposed the prayer for bail stating that at his instance money was deposited.. Having heard both sides and in view of the facts and circumstances, as stated above, I am not inclined to grant privilege of anticipatory bail to the petitioner, however, the petitioner is directed to surrender before the learned court below and make prayer for regular bail, which will be considered by the learned court below without being prejudiced by the order of this Court.

With the aforesaid direction, this application is dismissed.
